ZONG PRIVACY POLICY

 

 

Overview

 

This Privacy Policy describes how the Zong division of Echovox, Inc. (“Zong”) treats information that it collects and receives related to your use of Zong’s payment services (“Zong Services”) and website.

 

Applicability of Privacy Policy

 

This policy only applies to Zong and not to other businesses of Echovox, Inc. or to other companies.  This policy does not apply to information provided by publishers and other third parties who have contracted with Zong to provide Zong Services to their customers; that information is governed by the agreements they have with Zong.

 

Information Zong Collects and Uses

 

Zong does not collect any information that identifies you personally other than your mobile phone number. For purchasers who use the Zong Services, Zong collects data related to your purchase, including your mobile phone number, telecommunications carrier information, and data related to you purchase of goods, such as the purchase amount, the name of the seller and the application and/or website location from which the goods are made available (“Transaction Data”). For website visitors, Zong may collect information regarding IP addresses, domain servers, referring/exit pages, operating system, date/time stamp, clickstream data, type of computer or mobile phone, type of web browser, one or more cookies that identify your browser, and telecommunications carrier information (“Traffic Data”).  Zong may aggregate Transaction Data and/or Traffic Data for the purposes of making the Services available to you.

 

Information Sharing and Disclosure

 

Zong uses Transaction Data to process purchase transactions initiated by you and to communicate with you as part of the transaction process.  Zong shares Transaction Data with your mobile carrier and the seller of the goods you’ve purchased as necessary to process the transaction and for post-purchase support.  Zong uses Traffic Data to improve the Services. 

 

Zong may use and disclose other Transaction Data and any Traffic Data on an aggregated basis.

 

Zong may engage a trusted third party to perform limited functions on our behalf, such as verifying carrier information, SMS communications, analyzing and processing data (such as billing information), and providing customer service. We require that these parties agree to use such information in a confidential manner and in compliance with this Privacy Policy and any other appropriate confidentiality and security measures.

 

Zong may share Transaction Data with third parties when legally required to do so, at the request of governmental authorities conducting an investigation, to verify or enforce compliance with user agreements and applicable laws, to protect against fraud, to detect and prevent security or technical issues, to protect against misuse or unauthorized use of the Zong Services, or website, or to protect against imminent harm to the rights, property or safety of Zong, its users or the public as required or permitted by law.

 

Zong may share Transaction Data with a successor entity or in connection with a corporate merger, consolidation, sale of assets or other corporate reorganization provided that use of Transaction Data is in compliance with this policy.

 

Zong may share Transaction Data with a third party if you have consented to receive information from that third party through use of the Zong Services.  Such third parties will handle, store, retain and access such user information in accordance with the terms and conditions of their agreements with you, if any, as well as their own privacy policies. It is your responsibility to carefully review such agreements and privacy policies.  You acknowledge that Zong shall have no liability to you for sharing of such information to such third parties and Zong disclaims any and all liability relating thereto. 

 

We process Traffic Data to provide the Services and as part of the provision of Services, we may process other personal information on behalf of and according to the instructions of a third party, such as Sellers from whom you purchase goods, but only when you have provided your express consent to allow us to do so.

 

If Zong desires to use Transaction Data for any purposes other than those described in this policy, we will offer you the opportunity to opt out of such use for those other purposes.

 

Cookies

 

When you visit the Zong website, we may send cookies to your computer that uniquely identify your browser. We use cookies to improve the quality of our service by storing user preferences and tracking usage information. Most browsers allow you to disable cookies or set your browser to alert you when cookies are being sent to your computer.  If you disable cookies, you may not be able to utilize certain Zong products and services.

 

Security and Data Integrity

 

When processing Transaction Data, Zong uses a Secure Socket Layer (SSL) that encrypts all information you input before it is sent to us. We have physical, electronic, and procedural safeguards to protect the loss, misuse, and alteration of the Transaction Data under our control. Transaction Data we collect is stored in a secure manner that is accessible only by authorized Zong personnel and is only disclosed under the provisions of this policy.

 

Children's Personal Information

 

The Zong website complies with the Children's Online Privacy Protection Act ("COPPA"). Zong does not knowingly collect Personal Information from children under the age of 13 through the Zong website. In addition, in the event that a user identifies himself or herself as a child under the age of 13 within the Zong website, Zong will not collect, store or use any personally-identifiable information of such user. Further, in the event that Zong receives any personally-identifiable information that Zong discovers was provided by a child under the age of 13, Zong will promptly delete such information in a secure manner.

As a convenience to you, we may provide links to third-party web sites from within our website or our products or services. Zong is not responsible for the privacy practices or content of these third-party sites.

 

Modifications of Privacy Policy

 

Zong reserves the right, at our discretion, to change, update or modify this policy at any time by posting such change, update or modification on the Zong website. Any such change, update or modification will be effective immediately upon posting on the Zong websiteYour continued use of the Zong website and/or any Zong products and services following the posting of changes constitutes your acceptance of the revised policy then in effect.

Zong adheres to the Safe Harbor privacy principles of Notice, Choice, Onward Transfer, Security, Data Integrity, Access and Enforcement developed by the U.S. Department of Commerce and the European Union, and is registered with the U.S. Department of Commerce's safe harbor program. While Zong typically processing Transaction Data within the geographies from which it has been provided, Zong may process Transaction Data on our servers in the United States of America. If we receive formal privacy-related complaints regarding such processing, we will cooperate with appropriate authorities, including European Data Protection Authorities, if we cannot resolve privacy complaints.]
